Terms of Service (AGB)

1. Scope & Agreement

By accessing phasi.app ("Service"), you agree to these Terms of Service (AGB). If you do not agree, do not use the Service.

2. Service Description

The Service provides visual planning and cross-department alignment for engineering-driven organizations. The platform is cloud-based and hosted in the EU.

3. No PLM/ERP Replacement

Phasi is a coordination layer. It is not a replacement for PLM/ERP or critical safety systems. Users remain fully responsible for engineering decisions and regulatory compliance.

4. Early Access / Beta Disclaimer

The Service is in Early Access and under active development. Functionality may change or be removed at any time. Data loss, instability, interruptions or resets may occur without notice. No uptime guarantee or service-level agreement applies. You acknowledge that you use the Service entirely at your own risk and agree to maintain independent backups of all data. The operator assumes no liability for data loss, engineering errors, or business losses resulting from usage.

5. Eligibility

You must be legally able to enter contracts and at least 18 years old.

6. Accounts & Security

You are responsible for safeguarding credentials. We may suspend access if we detect abuse, risk, or legal request.

7. Customer Data & Backups

Users retain rights to their workspace data. We process data only to operate the Service.

We do not guarantee data recovery. You must maintain your own backups.

8. Acceptable Use & Restrictions

No unlawful use, no reverse engineering, no harmful data, no unauthorized confidential data.

9. Fees, Trial & Renewal

A 14-day trial may be offered. To avoid continuation and invoicing after the trial, you must send a written cancellation to sales@phasi.app before the trial ends. Failure to cancel results in automatic continuation and invoicing according to the selected plan and number of seats.

Current Early Access plans:

• Starter — 1 project, up to 5 users — €69 / month (or €699 yearly)

• Team — up to 10 projects, up to 20 users — €199 / month (or €1990 yearly)

• Premium — up to 30 projects, unlimited users — €499 / month (or €4990 yearly)

• Enterprise — unlimited projects & users — custom pricing

Paid subscriptions renew automatically unless cancelled. The cancellation notice period is one (1) month prior to the end of the respective billing cycle (Monatsfrist zur Kündigung vor Ablauf der Vertragslaufzeit).

No refunds for partial periods or trial conversions. Prices may change with notice.

10. Payment Terms

Payment is currently accepted via invoice / bank transfer only. Online card payments may be introduced later.

Invoices must be paid within the stated payment term. Late or unpaid invoices may result in suspension of access.

11. Warranty Disclaimer

The Service is provided “as is” and “as available”. No warranties.

12. Limitation of Liability

To the maximum extent permitted by law, the operator is not liable for any direct, indirect, incidental, consequential or business losses, including engineering or production errors. Total liability shall not exceed EUR 100.
